Flight Day Rules
Safety briefing (hereinafter referred to as the "Rules") for persons participating in a SIGHTSEEING FLIGHT (hereinafter referred to as the "Flight") or an EXPERIENCE FLIGHT (hereinafter referred to as the "Flight") or an INTRODUCTORY FLIGHT (hereinafter referred to as the "Flight") or a COST-SHARED FLIGHT (hereinafter referred to as the "Flight").
1. INTRODUCTORY PROVISIONS
1.1. The following Rules specify in detail the conduct around the helicopter before, during, and after the provision of the Experience.
1.2. Words and expressions beginning with capital letters shall have the meanings defined in the General Terms and Conditions.
1.3. By checking the box „I agree to the General Terms and Conditions, Privacy Policy, and Rules of Conduct around the Helicopter“ and by signing at the location and on the date of the Experience, the Buyer agrees to the wording and provisions of these Rules and undertakes to comply with them.
1.4. In the case of a Beneficiary, a signature of these Rules at the location and on the date of the Experience shall suffice.
1.5. The Buyer or the Beneficiary, depending on who is to receive the Experience, will not be provided with the Experience in its entirety if they do not sign these Rules at the location and on the date of the Experience prior to the Flight.
1.6. The Buyer or the Beneficiary, depending on who is to receive the Experience, may be denied the Experience in its entirety if they act in violation of these Rules.
2. INSTRUCTIONS FOR CONDUCT AT THE EXPERIENCE LOCATION
2.1. The Buyer or the Beneficiary, depending on who is to receive the Experience, must:
(a) sign a declaration of familiarity with the Rules as well as consent to comply with them;
(b) comply with the Rules;
(c) follow the instructions of the authorized person in order to ensure safety;
(d) maintain a safe distance from the helicopter and other equipment of the Provider, particularly by staying outside the restricted area;
(e) submit to weighing upon the request of an authorized person for the purpose of verifying the accuracy and truthfulness of the previously stated weight data;
(f) personally assess their health status and fitness to participate in the Flight, and by agreeing to the Rules, they declare that they do not suffer from serious medical complications, particularly that they do not suffer from epilepsy, heart disease, loss of vision, mental disability, or other serious illnesses to such an extent that they could affect the Flight itself or the safety of the Buyer or Beneficiary or the safety of other persons on board;
(g) immediately leave the restricted area upon completion of the Flight according to the instructions of the authorized person, specifically ensuring they do not approach the tail rotor of the helicopter;
(h) provide correct and truthful information for the purpose of completing pre-flight formalities.
2.2. A Buyer or Beneficiary, depending on who is to receive the Experience, who is a person under 18 years of age, must further:
(a) be at the location and on the date of the Experience with the demonstrable consent of their legal representative, who must also sign the declaration of familiarity with the Rules and consent to comply with them;
(b) be constantly accompanied and supervised by a person with full legal capacity who is responsible for their conduct.
2.3. The provisions of paragraph 2.2 shall apply to persons with limited legal capacity mutatis mutandis according to the circumstances, particularly the extent of the limitation of such person's legal capacity.
2.4. The Buyer or the Beneficiary, depending on who is to receive the Experience, must not:
(a) enter or move within the restricted area unless expressly invited to do so by an authorized person;
(b) touch or otherwise manipulate the helicopter or other equipment of the Provider unless expressly invited to do so by an authorized person;
(c) raise hands, children, or other persons, or anything else in the vicinity of the helicopter, nor throw anything away;
(d) disrupt the peaceful course of the provision of Experiences, particularly by excessively bothering other participating persons.
3. INSTRUCTIONS FOR CONDUCT ON BOARD THE HELICOPTER AND DURING FLIGHT
3.1. The Buyer or the Beneficiary, depending on who is to receive the Experience, must:
(a) comply with and follow the instructions of the pilot or other authorized person;
(b) remain seated and buckled with seat belts in a calm manner at the designated place for the entire duration of the Flight and not interfere with any other space unless expressly invited to do so by the pilot or other authorized person;
(c) have all loose objects, such as cameras, mobile phones, etc., firmly secured for the entire duration of the Flight;
(d) monitor their health status and, in the case of any complications, immediately report this to the pilot or other authorized person.
3.2. The Buyer or the Beneficiary, depending on who is to receive the Experience, must not:
(a) manipulate the instruments and equipment of the helicopter unless expressly invited to do so by the pilot or other authorized person, particularly interfering with the controls, switching control elements, manipulating seat belts, removing headphones, etc.;
(b) open doors unless expressly invited to do so by the pilot or other authorized person;
(c) leave their designated place on board the helicopter unless expressly invited to do so by the pilot or other authorized person;
(d) disrupt the smooth course of the Flight, as well as the process immediately before and after the Flight, particularly by disturbing or restricting the pilot or other persons on board the helicopter;
(e) damage the interior of the helicopter;
(f) stick any objects, parts of objects, or parts of their own body or the bodies of other persons on board out of the helicopter;
(g) smoke;
(h) throw any objects or parts thereof out of the helicopter.
4. FINAL PROVISIONS
4.1. No provision of the Rules shall be interpreted as a narrowing of any provision of the General Terms and Conditions, but only as their clarification and extension. If there is a conflict between the interpretation of a provision of the Rules and the General Terms and Conditions, the broader interpretation shall be used.
4.2. If any part of any provision of the Rules is found or becomes invalid, illusory, or unenforceable in any respect, such part shall be ineffective only to the extent of such invalidity, illusoriness, or unenforceability, without any effect on the remaining parts of such provision or the remaining provisions.
4.3. Legal relationships established by or related to the Rules are governed by the laws of the Czech Republic.
4.4. The Seller is entitled to unilaterally change the Rules, whereby the new version of the Rules becomes effective on the date of publication.
